Humane Care Therapy Inc. is a therapy staffing company operating in Missouri City, Texas, and serving home health agencies and patients across Houston and Southeast Texas since 2018. In many circumstances, Humane Care Therapy Inc. functions as a Business Associate under the Health Insurance Portability and Accountability Act (HIPAA) in connection with services provided to home health agencies and healthcare providers.

This Privacy Policy applies to:

  • Patients and their families whose health information we receive in connection with therapy services
  • Home health agency partners and their staff who interact with our services
  • Clinicians and job applicants who submit credentials or apply for placement

2. INFORMATION WE COLLECT

2.1 Protected Health Information (PHI)

As a HIPAA Business Associate, we may create, receive, maintain, or transmit Protected Health Information (PHI) in connection with our therapy staffing services.

  • Medicare/Medicaid numbers and insurance information
  • Medical diagnoses, conditions, and treatment history

From clinicians applying for placement, we may collect:

  • Employment history and professional references
  • Social Security number and government-issued ID (for background checks and tax purposes)
  • Professional liability insurance details
  • Immunization and health records
  • Direct deposit and banking information (for payment)
  • Skills checklists and clinical competency information

2.5 Communications Data

When we communicate with you via SMS text message or voice call through third-party communication platforms, we may collect:

  • Phone number called or messaged
  • Date and time of communication
  • Message delivery status
  • Opt-in and opt-out records
  • Communication preferences
  • Consent language version presented at time of opt-in
  • Timestamp of consent event

We use Twilio (pending A2P 10DLC approval) as our SMS communication platform. Upon approval, Twilio will serve as our HIPAA-eligible SMS provider under a signed Business Associate Agreement (BAA). Where possible, we avoid including Protected Health Information in SMS message content.

2.6 Automatically Collected Information

When you visit our Site, we automatically collect:

Treatment To arrange, coordinate, and support the delivery of home-based occupational therapy, physical therapy, speech-language pathology, and medical social work services to patients.

Payment To verify insurance coverage, submit claims, and obtain reimbursement for therapy services from Medicare, Medicaid, and private insurance payers.

Healthcare Operations For quality assurance, credentialing, compliance monitoring, auditing, and business operations.

Humane Care Therapy Inc. follows the HIPAA Minimum Necessary Standard when accessing, using, or disclosing PHI.

As Required by Law We may disclose PHI when required by federal or state law.

Public Health Activities We may disclose PHI to public health authorities when legally required.

Serious Threats We may disclose PHI to prevent or reduce serious threats to health or safety.

Workers’ Compensation We may disclose PHI as permitted by workers’ compensation laws.

With Authorization Any other use or disclosure of PHI requires written authorization.

3.2 Uses of Non-PHI Personal Information

4. SMS COMMUNICATIONS

Important: The phone numbers and SMS consent information you provide to Humane Care Therapy Inc. will NEVER be sold, shared, rented, transferred, or disclosed to any third party or affiliate for marketing purposes. Your consent is used solely to send you communications directly related to our services.

Humane Care Therapy Inc. may communicate with patients, clinicians, and agency partners using SMS text messaging for appointment reminders, staffing coordination, and operational notifications.

By providing your mobile phone number and consenting to SMS communications through our website or other communication channels, you agree to receive text messages from Humane Care Therapy Inc.

You may opt in by completing the SMS consent form on our Contact Us page or Careers page.

Our SMS Programs

Humane Care Therapy Clinician Scheduling Program Sends therapy assignment notifications, assignment confirmations, and scheduling updates to licensed clinicians who have opted in via our Careers page. Consent is obtained via explicit checkbox opt-in on our Careers form.

Client Communication Program Sends appointment reminders and therapy-related updates to patients and contacts who have opted in via our Contact Us page.

Patient Appointment Confirmation Program As a HIPAA-covered entity, we may send appointment confirmation and reminder messages to patients using the phone number provided during referral or intake. These messages qualify under the FCC Healthcare Treatment Purpose Exemption to the TCPA and are strictly limited to treatment coordination. No PHI is included in these messages.

SMS Terms

  • Message frequency may vary depending on your interaction with our services
  • Standard message and data rates may apply depending on your mobile carrier plan
  • You may opt out of SMS communications at any time by replying STOP to any message
  • For assistance, reply HELP or contact us directly
  • SMS consent and phone numbers collected through our website forms are never shared with third parties or affiliates for marketing purposes
  • Providing your phone number and consenting to SMS is never a condition of receiving services or employment
  • Patient appointment reminder messages are limited to one per day and three per week per patient

SMS Platform

We use Twilio (currently pending A2P 10DLC registration approval) as our SMS communication platform. Twilio is a HIPAA-eligible provider. Upon approval a signed Business Associate Agreement (BAA) will be maintained with Twilio. Once registration is complete this section will be updated to reflect active status.


5. HOW WE SHARE YOUR INFORMATION

5.1 Sharing of PHI

We share PHI only as permitted by HIPAA.

This may include sharing PHI with:

  • Licensed clinicians involved in patient care
  • Referring home health agencies
  • Ordering physicians
  • Business Associates who provide services to our company under signed Business Associate Agreements (BAAs)

Examples include:

  • Secure fax providers
  • Email and document storage providers under BAA

We do not sell PHI and do not disclose PHI for advertising purposes.

5.2 Sharing of Non-PHI Personal Information

We may share non-PHI personal information with:

  • Service providers assisting in website operations
  • Analytics providers such as Google Analytics
  • Legal or compliance advisors
  • Successor entities in connection with mergers or acquisitions

We do not sell personal information to third parties for marketing purposes.


6. YOUR HIPAA RIGHTS

Under HIPAA, patients whose information we hold have the following rights.
